WAIVER/RELEASE In consideration of being allowed to participate in programs put on by Greater Newark Tennis & Education (GNTE) and related events and activities, the undersigned acknowledges, appreciates, and agrees that my child is voluntarily participating in sports activities organized by the GNTE. I understand that these activities involve inherent risks, including but not limited to bodily injury, property damage, and death, which may occur as a result of my participation. Therefore, on behalf of my minor child I agree to the following terms: 1. RELEASE AND WAIVER OF LIABILITY: I hereby release and forever discharge GNTE, its directors, officers, agents, employees, and volunteers (collectively, the "Released Parties"), from any and all liability, claims, demands, and causes of action that I may have now or in the future, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, whether caused by the negligence of the Released Parties or otherwise. 2. ASSUMPTION OF RISK: I understand and acknowledge that my child’s participation in the sports activities organized by GNTE involves inherent risks, including but not limited to bodily injury, property damage, and death. I and my child voluntarily assume all risks associated with my child’s participation in these activities. 3. INFECTIOUS DISEASES: understand that participation in sports activities includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist. 4. ABIDE BY RULES: i willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I or my child observe and any unusual or significant hazard during my presence or participation, I and my child will remove himself or herself from participation and bring such to the attention of the nearest official immediately. 5. INDEMNIFICATION: I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, and causes of action, including attorneys' fees and costs, arising out of or related to my child’s participation in the sports activities organized by GNTE. 6. MEDICAL TREATMENT: I authorize GNTE, its agents, employees, and volunteers, to obtain or provide medical treatment for my child in the event of any injury, illness, or other medical condition that may occur during my participation in the sports activities. 7. ACKNOWLEDGEMENT OF UNDERSTANDING: I have read this sports waiver, fully understand its terms, and understand that I and my child are giving up substantial rights, including my right to sue the Released Parties for any injury, death, or damages that may result from my participation in the sports activities organized by GNTE. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

I agree that GNTE has complete ownership of such material and can use said material for any purpose consistent with GNTE’s mission. These uses include, but are not limited to, videos, publications, advertisements, news releases, Web sites, and any promotional or educational materials in any medium. I acknowledge that I will not receive any compensation for the use of such images, video, likeness, etc. I hereby release and discharge GNTE, its agents, representatives and assignees from any and all claims and demands arising out of or in connection with the use of my name, likeness, image, voice and/or appearance, including any and all claims for invasion of privacy, right of publicity, misappropriation or misuse of image, and/or defamation. I represent that I am over the age of eighteen (18) years and that I have read the foregoing and fully understand its contents.* This release shall be binding upon me, my heirs, legal representatives, and assigns. This agreement is being made and entered into under the laws of the State of New Jersey and shall be governed and interpreted in accordance with the laws of said state. This agreement embodies the entire agreement of the parties (subject and photographer). No modification of the agreement.
